Private Clubs who intend to racially discriminate get away with it by being more clever and just saying they dont do anything with non-members, because they know blatant segregation will be up for legal challenge under various Civil Rights Laws. This has also already been legally hashed out in front of the Supreme Court. They ruled that private schools cant just racially discriminate and in so doing, used the KKK Act to determine that people cannot just form blatantly racist private groups.
