Technically still is a sucker punch and if investigated by a LEO would be under assault. Sure the satan dork had physical contact and under court could be argued so that he initially committed battery, however, the fact remains that the black guy escalated it to assault because he still could have made means to escape and avoid the physical confrontation altogether as it is on tape.

Also, the black guy needs a way to prove his life is in danger before escalating the situation to assault. From what I've seen on the tape it's really not there for him in his defense. What would make matters worse are the injuries of the satan dork.

Maybe our resident lawyer and street fighting expert @faustian could provide additional legal insight and counsel.

Imo, most of the street fights posted here are sucker punches and clear cut legal nightmares for these doofuses should they be prosecuted.


1. That wasn't a sucker punch, tecnically or otherwise. If you square up to somebody like that, you should expect to get hit.

2. This post confuses "assault" with "battery." Battery is non-consensual touching. Simple assault is creating the apprehension of fear of a physical attack. EG if you force somebody to flinch because you feint like you're going to throw a punch, that's a simple assault.

3. The law of self-defense is proportional. You only need to be in fear of your life if you're going to use deadly force. If you somebody is trying to intimidate you and, and you punch them, that's generally considered proportional force.

Now, yes, a cop could arrest the black guy for happened there, and a DA could get a conviction on a wide range of charges. However, there's a great deal of discretion when it comes to incidents like this. An aggressive DA who really wants to nail somebody to the wall can get a conviction pretty easily on just about anything if the defendant doesn't have proper legal representation.

Realistically speaking, this situation was mutual antagonization and mutual combat.

And totally unexpected too; I watched without sound and was totally expecting dude on right to be launching the attack.
Thought so too. Whoever makes the first move wins that one. Guy on the right was completely oblivious to that guy's body language.
