This. The first thing I do when someone tries to get into my face is put my hands up, open handed, get in a boxing stance, and try to create a little distance. The opened hands so it doesn't come across as overly aggressive, but defensive posture to be ready in case they try some bs.

Technically still is a sucker punch and if investigated by a LEO would be under assault. Sure the satan dork had physical contact and under court could be argued so that he initially committed battery, however, the fact remains that the black guy escalated it to assault because he still could have made means to escape and avoid the physical confrontation altogether as it is on tape.

He'd probably still get a cite for CPC 240/242-Assault and Battery in California if other dude wanted to press charges.

A good defense attorney would argue Satan's son is in violation of CPC 415-Disturbing the Peace by Challenging to Fight in public and the punch was reasonable because he was in fear of the imminent physical altercation.
