This thread is not about whether you think Trump did something criminal - rather, in case the responsible people / DAs think so, if prosecution should happen in your opinion.

One data point: Comey says no.

James Comey: Donald Trump should not be prosecuted after leaving office

  • President has insulted Comey and threatened him with jail

I'm hot and cold on the thought. I'm with Comey on the importance of fostering trust given that 70 million people still believe the elections were stolen. Prosecuting Trump would just add fuel to that fire and what good would come out of putting him in jail other than schadenfreude? We can still have our schadenfreude through the NY state investigations, and all the financial fallout he will suffer from a declining brand value. But the big question is what will we uncover once the Biden administration gets the Oval Office and we start finding out about all the things that were kept secret and weren't leaked? If we know they he has made attempts to involve the military against his own people for purposes of staying in power, or that he has had more dealings with foreign powers for domestic political benefit, then it could very well be too much to just a blind eye

He is right. And I fully expect conservative Biden to not pursue it at all.

So many people get cocky when their side wins. Unless you feel you can destroy the other side and eliminate Trumpism I dont think its worth the risk. The kids on here want heads, Biden is an adult so I expect a reasonable approach.

Almost always go with first option, but I guess it depends on the crime. I’m sure he’s done a lot of things (and not done things, like disclosing conflicts of interest) that can be retroactively filed as a crime, I don’t know that it’s worth it to put America through that clown show, though.

What's the worst that could happen if he committed crimes and they let him off the hook to try and "heal the nation"?

I don’t think he’ll be charged for anything he did while President. That’s a line that nobody’s going to cross. His kids won’t be granted that same level of protection. Campaign finance violations during the 2016 campaign are fair game, as are white collar crimes committed as the head of his company. They’ll need an open and shut case though, nobody’s gonna risk a failed prosecution of an ex-president.

why not prosecuting him if he committed a crime? he is equal to anyone else, nah?

Donald Trump should not be federally prosecuted once he leaves the White House no matter how much evidence has been amassed against him, the former FBI director James Comey writes in a new book.
I don't agree with the "no matter how much evidence".
If there is strong evidence he should be prosecuted.

I voted Yes, but it is a hesitant yes. The first order principle of civilization is rule of law, so in that regard, I see the purpose. However, in this case, you might end up with much less law and order if you prosecute him, as there is no feasible way to remove the political implications of such an act. Maybe it's a cost-benefit analysis situation? It could also set a bad precedent in that now losing an election has much more dire consequences and thus would encourage a non-peaceful transfer of power.

Well he’s been accused for 4+ years of committing a crime and the Dems will be controlling the House and Presidency and close to the Senate so now it’s time to put up and charge or admit that you were lying for years just to undermine Trump.

The slimy worm Comey knows this and is obviously trying to cover for his buddies.

If there is evidence citizen X committed a crime then law enforcement should investigate. I don't care if citizen X is DJT, or Joe Biden, or Bill Gates. being famous, wealthy, or powerful should not matter. SHOULD NOT. unfortunately that's not the world we live in and i wouldn't be surprised if Biden allows the DOJ to turn a blind eye to Trump.

The evidence to bring DJT to trial should at least be equal with all the evidence of election fraud. Fairs fair.

If he has committed a major crime and the evidence is good, sure. But if it's some meager BS that leads to nothing, then no.

This is such a tough one. Any charges are going to be viewed as a "partisan witch hunt" even though he had the most shamelessly corrupt admin in modern history. Then when the pendulum inevitably swings in the other direction, there will be ACTUAL "partisan witch hunts" and kangaroo courts that prosecute clean or relatively clean politicians along party lines using Trump as a precedent. The best thing, IMHO, (and I say this regretfully), would be to let things slide and hope a sizable % of Trumpers come to their senses and pretend that they "never knew the guy". Hopefully, ( I know this sounds really naive) within a couple cycles, Trump and his hangers on become less and less relevant and go away.

I believe he should. However, prosecuting him while letting the likes of George W. Bush walk away would be pure bullshit imo.
