It was, but I don't think Cain is a particular danger to anyone unless some extreme outlier situation happens. I'd be ok with giving him a 6 year sentence where he's already served time and will get time off for good behavior.

I'm not sure how much community work he would need to do to outweigh attempted murder and reckless engagement of innocent people.

I get that he was out of his mind with rage, but judges cannot afford to take this sort of behaviour lightly.

Sentencing is not only about appropriate punishment, it's also about setting precedent and deterring other people from doing the same thing.

He didn't have a criminal record before this because he was an athlete and never a criminal until after the head damage.

The range that he is looking at right now for sentencing is the 40-year maximum all the way down to only time served with probation (stated at the end of the video). If he got the latter, he would walk but be on probation. He's already done a year in jail, which is what the time served would reference.

There are 3 factors in play for him, (1) no criminal history, (2) he pleaded guilty, a trial would have added decades to his sentence if he were found guilty, (3) contrition, good standing in the community.

My prediction- he would be looking at an 8–10-year sentence; he will get that knocked down for the plea deal, he will get time served plus time off for good behavior. He will do less than 3 years of hard time following a verdict, if that. I've worked in corrections in CA, and that's about what similar cases I've seen have brought. I would tend to think they will land on the lighter side.

I agree with some prison time but let's be real. Cain has helped the community long before he committed this crime. He's done a lot more positive choices than negative ones.

What's the conversion rate? How many homeless do I need to feed before I'm allowed to shoot an innocent person?

That guys trial is in May so Cain will be sentenced before we know the outcome to that trial. As of now, he hasn't been convicted.

It is actually some time in the summer now. His lawyers did everything to ensure Cain's trial happens first.

I expect he'll do a bit of time. I hope the judge dosen't go heavy handed and end his free life basically as the judge very well has the power. But I also don't think something as wildly dangerous as what Cain did can be let off with a slap on the wrist. Hopefully no more than a couple of years.

He LITERALLY SHOT AN INNOCENT MAN. He fired SEVERAL SJOTS on CA, highways/expressways, etc.

Even right beside a school he was firing indiscriminately.

He almost killed one innocent person. And he didn’t give a fuck who was injured because of his actions.

As a judge.. I’d give him at least 10 years.

I didn't hear that. That doesn't bode well for Cain giving this guy a permanent injury; I know that matters in sentencing because the degree of the assault goes up when that happens.

I hope Cain can be free, we all as parents totally understand and sympathize. The only thing Cain did wrong was use a gun, he should have used his hands, its Cain Velasquez!!!!!!!!!!!!!.

I feel bad for Cain because I totally understand his actions, I just wish he used his hands, because he can control that, the gun is dangerous because the bullets can fly off anywhere and hit random people, especially when driving fast. It would have been great if Cain beat the snot out of that man. I don't understand why he used a gun because Cain Velasquez is the weapon himself, its the UFC HW champion!!.

I feel bad for Cain, I hope he will be free or if he does get a sentence it can be short. He is a good family man.
