Nah - he was wearing his uniform. That carries the weight and authority of the state.Assuming he wasn't on duty while he did this as a police officer that should leave him personally liable, and not the city.

I agree, but he wont be. He gave the guy an order to get on the ground which never happened. That's resisting arrest, so he was entitled to beat him unfortunately. Am I the only person in the world who thinks that when a cop has an asp/baton out and gives you a verbal command that you should immediately and with speed follow that order? It's not like he was going to get away from the cop... did the guy really have to wait until the cop hit him 7+ times before he realized he was needed to comply?
I know people think it's just about a tomato, but cops expect you to comply with their lawful order of "get down" or "hand behind your back." Even the "victim" here states that the cop issued him a verbal order and the video clearly shows a verbal interaction before the cop starts hitting him. If the guy had done as he was lawfully ordered in the first place nothing would have happened.

1. Of course not all cops are jerks.I often wonder... does being a policeman turns you into a psycho with self-esteem and inferiority complex issues? or does the jobs attracts people like that?
