You are confusing the criteria of conviction with the criteria of opening a criminal case. The reason why it didn't go to a criminal court is beyond ridiculous.

The woman was battered, there's reports of her by doctors she was traumatized, had a tampon incrusted in her vagina that had to be surgically removed by a forcep.

Anyone who thinks that was a "consensual" encounter is a moron.

The reason it didn't go to a criminal court is because her friend was there and didn't verify her story. She also didn't even remember having sex with the other dude, putting into doubt the rest of her testimony. And no, the tampon didn't need to be surgically removed. There is absolutely reasonable doubt here. The standards for a civil case are much lower.
