The defense would argue that he made those payments 10 years later because the news of the affair resurfaced. It wasn't a news story 10 years ago, but it was in 2016 and Trump decided to pay the money to save his son, wife and family the embarrassment.

Trump couldn't control public interest in his sex life, and if Stormy Daniels had come out in 2010 or whenever, he would have done the exact same thing. She controlled the timeline, not Trump.

Rudy has argued that to be illegal you have to prove the campaign is the SOLE reason. That will be the hard part just along with what you said.
