A normal plea agreement would protect him, https://courts.illinois.gov/Opinions/AppellateCourt/2019/2ndDistrict/2170030.pdf even if the plea was engregiously unfair / light. But this is a very unusual circumstance. The state’s authority to enter into the agreement was invalid, because the prosecutor was conflicted / recused. So far the court hasn’t specifically invalidated the plea itself. Could Jussie Smollett successfully assert double jeopardy if he’s charged again?

In a jury trial, jeopardy attaches when the jury is empaneled. In a bench trial, it attaches when the first witness is sworn. If conviction is secured by plea, it attaches when the court accepts the plea (see the link I posted above, an Illinois case from a few days ago). There are many exceptions to rules I listed. I’m wondering if there’s an exception for pleas that are a “product of official misconduct,” or something like that.

EDIT: I was under the impression that Smollett took a nolo plea (“no contest,” effectively a guilty plea). His charges were actually dropped pursuant to the prosecutor’s nolle pros motion. Under Illinois law, a nolle pros operates as a dismissal on the merits only if Jeopardy has attached. https://caselaw.findlaw.com/il-court-of-appeals/1685070.html Did jeopardy attach in his case? I would argue that it did not, but apparently Smollett’s lawyers are prepared to argue that it did: https://www.courthousenews.com/wp-content/uploads/2019/07/smollett-reconsider.pdf Smollett’s 31-page motion to reconsider appointment of the special prosecutor only briefly mentions double jeopardy. The argument is not fully fleshed out. From what little I’ve read of Illinois law, his hasty nolle pros hearing didn’t involve him being placed in jeopardy. That said, I’d have to see a transcript of the proceedings to know for sure. It’s possible that Smollett availed himself of “jeopardy” for purposes of precluding later charges.

Lawyers for Jussie Smollett on Friday filed motions contending that because the actor was the victim of an attack earlier this year in Chicago a judge should reverse his decision to appoint...
It's starting to look more and more like he actually wasn't a victim of a hate crime and that he in fact staged the whole situation.

I called this exactly nearly 2 weeks ago.
I'm no detective, but I'm beginning to suspect that he may have staged the attack.
 
Man what a story so far:

Chapter 1: Gay black actor almost lynched by two Trump supporting white supremacists - Question it and you are a racist.
Chapter 2: Holes in the story begin to appear. Public perception begins to change. Some lunatic Leftists still believe him.
Chapter 3: Overwhelming evidence against Smollett. Turns out he hired his friends to attack him. Police charge him. Suspended from Empire.
Chapter 4: Indicted on 26 counts. Smollett becomes a social pariah.
Chapter 5: Charges dropped by prosecutor who is friends with his family. Case sealed. Police not notified prior to dropping the charges. Police outraged. Society outraged.
Chapter 6: Smollett continues to claim innocence. Won't be invited back onto Empire. Empire cancelled after next season. Outraged city launches civil suit. Corruption investigation into the lead prosecutor. Men paid by Smollett to attack him sue Smollett's lawyers for defamation. One of the brothers who Smollett paid to attack him wins Golden Gloves tournament.
Chapter 7: New mayor in Chicago, city still proceeds with civil suit. Police union goes after Kim Foxx. Kim Foxx tries to play race card to avoid criticism for dropping the charges and having the case sealed.
Chapter 8: Judge orders special prosecutor to restore faith in the justice system. Has power to potentially charge Smollett. Kim Foxx's fate still yet to be decided. Evidence against Smollett released to public. Smollett looks ridiculous.
Chapter 9: ???

Then there's the connection to Kamala Harris a presidential candidate and the Obama's. His family claiming he suffers from night terrors because of trauma related to the event. His ridiculous TV interviews and fake tears.

Nice job. Amazing that he and his attorneys continue steadfastly down the "IT'S ALL STILL TRUE!!!" path on this one---as recently as yesterday.

No issue lying through their teeth, even when everyone else on the planet knows they are lying through their teeth. It's very telling.

I can't help but get the feeling that you think he's partisan because you view partisanship as basically identitarian, progressive left VS identitarian right - and if they're not with you, they're against you. You're talking to a Republican, or at the very least someone who has had an official role in the party in the past. Have you ever read his breakdown of what Republicanism means to Pan? The modern identity driven Republican isn't the only type there is. There are other Republicans who are somewhat displaced in today's "BUILD A WALL! LOW TAX, BIG SPEND!" political environment and really don't care about most of the stuff Trump made an impact with and are more concerned with balanced fiscal policy. As far as I know, that's Pan. Everyone is partisan to an extent, but I suspect you only find him partisan in an offensive way because he doesn't follow the same marching orders you do - not because he's some globalist leftist whatever.
