Depends on the scenario. At the very least it's ussually negligence that led to a murder from the dog & manslaughter for its owner. Same charges as if you shoot somebody playing around with a firearm or menacing.

- If there was no proper containment or adequate enclosure based on the dogs capabilities i.e. fence height, strength, condition. How secure & responsible were you with keeping your responsibility away from people and keeping people away from your dangerous weapon.

- The lead or tools used to handle the specific animal based on weight and capabilities. Muzzles, harnesses, prong collars, e collars, shock collars. Did you have tools or means to dispatch of the animal if you physically couldn't stop the attack.

- Failure to stop the attack due to not being able to handle, control, or subdue or responsibility. Or insufficient supervision that allowed for the animal to be out of your control long enough to inflict deadly force.

-If the animal had a history of aggression towards humans before. Up the penalties

-If you introduced your dog to a public area or setting how much socialization or training did you give it prior.

Generally the owner/handler is always going to be in the wrong here & I'm for stiff penalties that are aligned with other negligent homicides/manslaughter.

Dog breed does matter, but there are a lot of breeds that would be just as dangerous given the same situation... pitbulls are just super common among shitty owners.

A pitbulll ban would be ineffective as the shitty owners would just go to another athletic protective breed... in order for a ban to work you'd have ban half of the known breeds over 40lbs.
