it's up to the commission they can either cancel the fight or allow it. Hendo probably didn't want to take the chance since he was so close anyway.The fight wouldn't be sanctioned if someone was under the weight limit.
That's why Hendo had to eat like a mad man before weigh-ins once when he stepped up in weight.
