You can say "Absolutely not", but it is how the law works. Heat of passion killings due to adultery often gets 1st degree murder charges reduced to 2nd degree or manslaughter. And the same applies to assault charges.
1st degree assault can be 15-20 years. It requires proof that he went to the house intending to do the aggravated assault before he saw them in bed.
2nd degree assault by comparison, assuming they go the "Crime of passion" route, by comparison, is 5 to 10 years.
So the difference between her saying they have been broken up for months and he just showed up and attacked them while they were hanging out vs They were still dating and she gave him a key to her place when he walked in and found her in bed with another man is a big one.
She needs to keep her story straight, or he is going to able to cast doubt on her story in court. And for the record, I WANT this ape behind bars. He already put some groundwork down to imply she pulled the knife on him after he sent the other guy out the door and he was "fighting for his life" and ran because he knew his previous record would make people not believe him.
The fact that she has changed around multiple parts of her story is a bad thing and will come under scrutiny if he gets a good lawyer and fights some of the charges.
Obviously, the attempted murder charge is a big one too. However, she "presumed" he was going to the kitchen to get a knife to kill her, but it is going to be hard to make that one stick. I get confused at that part because on one story, she says he held the knife near her head and threatened her, then went to get something else to "finish the job", in another, she claimed he pushed the knife into her hand, ear and chopped her hair off(Which was not in the police report she filed). The ogre could easily just say "finish the job chopping her hair off", and the attempted murder charge comes into reasonable doubt.
The parts about "cancelling her stuff on her phone so nobody would wonder at her whereabout's" seems like a fishy add on as well. That would seem to be an important thing to tell police.
