Trump can’t get out of deposition in E. Jean Carroll defamation lawsuit, judge rules

A federal judge rejected former President Donald Trump’s attempt to pause his deposition in a defamation lawsuit scheduled for later this month saying Trump’s efforts to delay the case are “inexcusable.”

Trump is scheduled to be deposed on October 19 in the defamation lawsuit brought by E. Jean Carroll, a former magazine columnist who accused Trump of raping her in a department store in the mid 1990s. Trump has denied the allegations.

Judge Lewis Kaplan said the lawsuit wasn’t over yet and as they wait for a federal appeals court to rule on a key element of the case, “completing those depositions – which have already been delayed for years – would impose no undue burden on Mr. Trump, let alone any irreparable injury.”

“The defendant should not be permitted to run the clock out on plaintiff’s attempt to gain a remedy for what allegedly was a serious wrong,” Kaplan wrote.

The judge said that Carroll would face “substantial injury” from further delay, citing the lengthy appeal process, which has already taken 20 months and is still not over, and the ages of Carroll and Trump, who are both in their 70s. Carroll’s deposition is scheduled for this Friday.

Kaplan noted Trump’s efforts to delay the lawsuit and said his production of “virtually” no documents was “inexcusable.”

An attorney for Trump could not immediately be reached.

“We are pleased that Judge Kaplan agreed with our position onto to stay discovery in this case. We look forward to filing our case under the Adult Survivors Act and moving forward to trial with all dispatch,” said Roberta Kaplan, Carroll’s attorney.

Carroll’s attorney had suggested that Trump wanted to stop his deposition after learning that she intends to sue him in November under a new New York state law that allows victims of sexual assault to sue years after the encounter.
The judge said the question of whether Trump raped Carroll is “paramount” to the current case and the future lawsuit and stopping the deposition now because it could be used in the future “would make no sense.”

Mr. If You Plead The Fifth You're Guilty will have to sit for deposition next week. sure he'll plead the fifth over 400 times, and if he ever answers a question it will be to say "i can't remember" or "i cant recall" but we all know that diaper don would never do anything like that. he's too busy being a devoted christian family man to ever put his pecker where it doesnt belong. even if it only costs him 130 grand per-pump.

Trump's team is still actively stalling, and are currently appealing what their own appointed Special Master can review.


going by how speedy they were able to find all of that election fraud and get their post-election lawsuits filed, the DOJ should add druncle rudy and the kraken gang to their team. the angry creamsicle would have been arrested within days, or even hours of the crime even occuring. they probably would have had their charges all written up and ready to go before the crime was even committed!

sure in that amount of time they arent going to be able to put a case together solid enough with no holes in it to lead to a conviction of a former president, but at least they would have those charges filed fast and they wouldnt even care if they got paid. at least agent orange wouldn't have to wait very long before he gets perp walked.

The DOJ had urged the Supreme Court to deny Trump’s appeal.

In a court filing Tuesday, U.S. Solicitor General Elizabeth Prelogar argued that Trump has “no plausible claims” to the classified records.

The Supreme Court, in its order Thursday, said, “The application to vacate the stay entered by the United States Court of Appeals for the Eleventh Circuit on September 21, 2022, presented to Justice [Clarence] Thomas and by him referred to the Court is denied.” There were no dissents by any of the Supreme Court’s justices noted in the order.

Thomas has oversight over emergency appeals from the 11th Circuit.

Trump’s appeal to the Supreme Court was on a relatively narrow issue and was not expected to affect any ultimate decision by DOJ on whether to file criminal charges against him or others.

Even if he had prevailed, the DOJ would have been able to continue its review of the classified documents, and almost certainly been able to use them in the probe. The DOJ has said the review is necessary to determine if there might be other documents that were not uncovered in the raid.

the demander-in-chief is running out of time and the supreme court has just struck down the only option he had left as a last ditch desperation effort to try to stall the DOJ from accessing those classified documents they recovered from his golf course and using it against him in a criminal prosecution. whats next? is the tangerine tornado simply just going to stamp his feet some more and tell everybody that clarence thomas has defected and sold out to the deep state and he is now part of the witch hunt orchestrated by the radical left and the weaponized DOJ, on this political hitjob, the likes of which the country has never seen before?

i guess all thats left now before he comes under indictment is waiting for the 11th circuit to laugh donnie out of court some more after the DOJ appeal. not that the DOJ even cares much about that in the grand scheme of things anymore. theyve already got everything they need to make their case and get a conviction, all safe and secure in their hands. its not going anywhere! and the DOJ really has no interest in the rest of the documents unless more of them surprisingly turn out to be incriminating as well and they can use it in their prosecution as well, but they already knew what they had and had everything seperated and all their bases covered well before the special master came in. so it doesnt even matter what the 11th circuits ruling is with the DOJ's appeal, which they have agreed to fast track.

the only thing the special master can do now at this point is buy bunker boy an extra little month or so of time just to get to where we're already at, and at worst, find more government documents that he wasnt supposed to have and then bestow ownership of them to the DOJ to use against him. now this is if the special master doesnt get axed in the appeals court, and if donny cooperates with him. if he doesn't theyre just going to side with the DOJ and give all those documents to the DOJ anyways. he's bloody well fucked right now, regardless of the 11th circuits ruling. theres nothing more he can do to stop or prolong those walls from coming down on him.

he hasnt quite figured out that after he has appointed a federal judge, he has now became disposable and he is no longer of any use to them.

the supreme court justices are in it for life. they will serve their terms as multiple presidents go in and out of the whitehouse. they don't owe him any favors and he's useless to them now. all the crying and raging that big baby butthurt does from here on in is moot to them. their jobs are secure. so of course they aint gonna be obligated to do him any favors.

the only thing that entertaining or even recognizing private citizen donald trump's desperate little chihuahua barks would do is just turn some of the public opinion against the justices themselves. and maybe they dont want to deal with that kind of ourage in their personal lives. the scotus has always tended to stay out of those muddy political disputes in the first place. so its nice to see that they didnt do him a solid and bend the knee to another one of his demands, just purely out of political partisanship.

it didn't work right after the election, and it didnt work now. the SCOTUS don't owe him anything. law and order baby! and just as donald trump once said, "nobody is above the law."
