Personally I doubt any are US citizens, it's too early for the administration to pull that off... but it's very likely that some aren't criminals, or even here illegally, and now they will likely die a horrible death in a foreign prison that we paid to dispose of them.

Nah, there's no "flagrant abuse of the law" lol. Most countries knew Biden had opened the border, eliminating most obstacles to entering and remaining in the US, so it's fair to speculate Venezuela helped push the criminal element out of their country in to the US.

You're ducking the question. As it is written, can the Alien Enemies Act be applied to anything other than a country?

In 2020, there were less than 1300 Venezuelans encountered at the border. between 2021 and 2024 there were almost 600,000 Venezuelans encountered at the border. That definitely qualifies as an invasion.

"Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event..."
