The police need a victim. If the victim signs an out of court settlement with an NDA, clearing McGregor in private and agreeing not to testify, then the Crown Attourneys have no case.
Once the victim stops cooperating, they lack the evidence to convict.
No actually they don't. Now there are cases where the victim not being willing to testify means theres not enough evidence (ie. the Kobe Bryant case), but if they have enough evidence, the victim testifying isn't absolutely necessary. This happens more so in domestic violence cases where the victim is back with the alleged abuser and refuses to testify but the court can use physical evidence, photos and the victims statement on what happened as evidence in a trial.
