I think that like the fight over the gay wedding cake, there are competing liberties involved.

Affirmative action has been upheld by the supreme Court, and has been made law through legislation. It doesn't surprise me one bit that they would take this position.

Women are eligible for Affirmative Action. There are more White women than there are Black men+women combined.
White men and women who identify as Hispanic get Affirmative Action.

Cameron Diaz, Christina Aguilera, Desi Arnaz (I love Lucy fame) , Ted Cruz, Giselle Bundchen (Tom Brady's wife) , Jorge Ramos, Marco Rubio etc.. are all Hispanic/Latino and White.

And if American's of Spanish ancestry (direct from Spain) can tick the Hispanic box, then Martin Sheen and many others are also Hispanic.

A person if Irish, German, Italian , Spanish, Welsh descent who lives in Argentina and decides to emigrate to the US will receive Affirmative Action. Someone like Alberto Fujimori, the former President of Peru, who looks totally Japanese, would receive Affirmative Action in the US.
