Never. My point more is that yes some doc's over prescribe pain meds but some responsibility has to be taken by the patients too as they're the ones controlling what they intake too.
 
I don't support drug prohibition or legalization. I support the reality that drugs are currently illegal at the federal level and the law should be followed. If the government makes drugs legal then that law should be followed as well.

Right now, selling certain drugs is illegal under specific circumstances. Selling other drugs is legal under specific circumstances. If people don't like the laws, get them changed. Don't complain about the consequences of existing law.


Then if doctors start getting hammered legally for all the big-pharma they allow people access to you'll have nothing to say other than that's the law? Doctors should get out of the business if they don't like it? Really though you're just ducking the obvious inconsistency in your two positions. Because by saying the law should be followed you're supporting it.

As for the notion that we should all follow all the laws regardless of whether or not we agree, a lot of great social change has come from civil disobedience. Glad everyone doesn't have your attitude. :D

I agree that patients bear a large portion of the responsibility. But prescribers bear responsibility as well. Not in every case, but in the cases where they are negligent in executing their professional responsibilities. Schedule II narcotics like oxycodone can't just be prescribed by anybody. In fact, schedule II medications are scheduled that way because they are extra dangerous with regards to their abuse potential. So, when a prescriber writes for oxycodone 10mg 4x/day for a twisted ankle and then re-writes that prescription over and over again without an examination or questioning the necessity or considering the consequences... he/ she is fucking up. And it happens all the time.

And when a prescriber is irresponsible in writing prescriptions that he knows are not valid, or even suspects they may not be valid, then he/she should be held accountable.

Irresponsible in whose opinion? The doctor's opinion? The patient's opinion? And accountable to who?
 
Or is it rarely prosecuted because its underreported and difficult to prosecute? You don't know how often this occurs.

It's difficult to prosecute because it's difficult to tell someone after the fact that they should have made a different decision based on the information that they had at the time.

Doctors have discretion in how they conduct their jobs. You might disagree with someone's judgement, that doesn't make it a crime.

Your stock broker suggests a stock. You buy it and lose money. It's very easy to claim after the fact that the broker should have known the price would drop. But we don't criminalize it because we know better.

There's no inconsistency in your statement. If doctors break the law they should certainly be prosecuted. But no one has described doctors breaking the law. They've described a subjective opinion on how doctors are applying the law. See, doctors have professional discretion written into the law. Drug dealers don't.
