The DoJ is under the President. The President’s subordinates charge people with crimes all the time. The Judicial branch is not strictly in charge of charging people with crimes. It is in charge of ensuring that the proceedings are carried out according to the law.

Other nations like Italy specifically are different in that their Judicial system is also the branch that indicts. The US is not like that. You don’t know what you’re talking about.

And no, it’s been spelled out for you over and over. Congress has a special power called impeachment for charging and potentially convicting officers of the US government, including the President, with crimes.

impeaching someone doesnt charge them with a crime. it removes them from office. then the congress can write a letter to the justice department suggesting criminal charges.

When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

It’s a conviction. The penalty is removal from office. Then further convictions on garden variety charges can be sought.

Why do you waste so many posts arguing that a conviction isn’t a conviction?

No they can be charged with a crime by the Judiciary Branch of the government if they are impeached by Congress and no longer President. If they are not impeached. Then yes. Nothing will happen.

i was clear from the beginning, people just seem to get things confused. I did say earlier that the President cant get arrested for jaywalking. Technically he can get arrested for jaywalking if congress convenes a session and votes to impeach the President and then sends a letter to the justice department strongly recommending that the President be charged with jaywalking and then the local district attorney can file a warrent on the former President for alleged jaywalking and then the former President, as an american citizen, can be put on trial in front of a jury of his peers to determine his innocence or guilt.

Clause 7: Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
