Law Kathryn Steinle's Murder: Illegal Immigrant Found NOT Guilty of Manslaughter by San Francisco Jury

Depends on state law, but usually manslaughter. Which is pretty much what I would name my metal band, if I had one.
I think we need a gender neutral version of the term "manslaughter". I feel triggered.

Does this set a precedent moving forward that if you fire a gun accidentally and kill someone you get off Scott free even if it’s about the most negligent thing you could possibly do. He lied about the “accident” 3 times according to CNN. How does this affect gun crimes moving forward?

Also, California might have some of the dumbest people on Earth. I highly suggest people look at Mark Dice's street videos where he asks people basic questions (what is the capital of America, what is July 4th celebrating, who won the American Civil war, etc) or tells them some insane scenario happened. It's really soul-deadening stuff the level of complete ignorance and the pride associated with it.

I don't think chopped up youtube videos showcasing the ignorance of the American public is indicative of the population at large.

A very old video I remember seeing involved someone suggesting a triangle had no sides. Another one suggested Hillary should be impeached. Etc.

A San Francisco jury found Jose Ines Garcia Zarate, a repeat felon who was deported five times, guilty of illegally possessing a firearm. But they acquitted him of murder and manslaughter in the shooting and killing of Kate Steinle, 32 years old, while she walked with her father on a San Francisco pier on July 1, 2015.

The single bullet that killed Ms. Steinle ricocheted off the ground before hitting her, ballistics experts testified at trial.

Prosecutors said at the trial that Mr. Garcia Zarate was playing a dangerous game of “Russian roulette” by firing the gun on the crowded pier and that he knew exactly what he was doing.

Mr. Garcia Zarate’s public defender, Matt Gonzalez, argued that the shooting was an accident. Mr. Gonzalez said his client found the gun after it had been stolen from a U.S. Bureau of Land Management ranger’s parked vehicle.

After the verdict, Ms. Steinle’s family told the San Francisco Chronicle Thursday that they were stunned by the news.

“We’re just shocked—saddened and shocked…that’s about it,” her father, Jim, said. “There’s no other way you can coin it. Justice was rendered, but it was not served.”

Mr. Trump and Attorney General Jeff Sessions have frequently cited the case as an example of crimes committed by illegal immigrants as they seek to crack down on sanctuary cities like San Francisco and tighten the country’s borders.

“A disgraceful verdict in the Kate Steinle case!” the president tweeted Thursday night. “No wonder the people of our Country are so angry with Illegal Immigration.”

The Justice Department is exploring whether federal charges could be filed in the case, according to a person familiar with the government’s deliberations.

Tom Homan, deputy director of U.S. Immigration and Customs Enforcement, said Ms. Steinle’s death would have been prevented had San Francisco complied with a request to turn him over to federal authorities. He said his agency would move to take custody of Mr. Garcia Zarate and ultimately deport him.

Mr. Garcia Zarate had been freed from San Francisco County jail on an old drug charge months before the shooting, despite a request from ICE to the sheriff’s department that would have enabled the federal agency to take him into custody. The city doesn’t honor these requests from ICE.

The case was among several that Mr. Trump cited in his repeated pledge to crack down on sanctuary cities—jurisdictions that limit cooperation with federal immigration authorities—in part by curbing some federal grant money. A federal judge in San Francisco earlier this month issued a nationwide, permanent injunction barring the government from doing that.

The murder case inspired legislation that has stalled in Congress. Called “Kate’s Law,” the legislation would increase penalties for criminal aliens caught re-entering the country.

Mr. Sessions on Thursday night seized on the case to underscore the administration’s battle against sanctuary cities.

“I urge the leaders of the nation’s communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers,” he said.

Jeff Adachi, who heads the public defender’s office in San Francisco, said the verdict showed that Mr. Garcia Zarate was able to get a fair trial “regardless of the tremendous amount of negative publicity.”

Alex Bastian, a spokesman for the district attorney’s office, said it wasn’t the verdict prosecutors were hoping for.

Mr. Garcia Zarate could be sentenced to a maximum of three years behind bars for the illegal possession conviction.

Once his prison term ends, Mr. Garcia Zarate stands to be swiftly deported back to Mexico. Under U.S. immigration law, he is barred from returning to the U.S.—even as a visitor—because of his multiple felony convictions, including for re-entering the country illegally.

A Mexican national was acquitted of murder and manslaughter charges Thursday in the fatal shooting of Kathryn Steinle, a Bay Area woman whose slaying in 2015 became a flashpoint in the national debate over people in the U.S. illegally and the role of local police in enforcing federal immigration laws.

Jurors deliberated for several days before returning the verdict in the trial of Jose Ines Garcia Zarate, who had been deported five times and freed under sanctuary laws before the fatal shooting. They convicted him on a single count of being a felon in possession of a firearm. He has not been sentenced.

The verdict brought a swift response from President Trump, who had cited the slaying during his campaign to make his case for building a wall across the U.S.-Mexico border and to punish cities he accused of not cooperating with immigration enforcement.

“A disgraceful verdict in the Kate Steinle case!” he tweeted Thursday. “No wonder the people of our Country are so angry with Illegal Immigration.”

Reaction came quickly from other quarters as well. U.S. Atty. Gen. Jeff Sessions says he hopes the not guilty verdict will make local officials “consider carefully the harm they are doing to their citizens” by not cooperating with federal immigration officials.

And U.S. Immigration and Customs Enforcement said it will take custody of Garcia Zarate once his case concludes.

During the trial, the defense called an expert who testified that an unintentional ricochet shot killed Steinle. They argued that the weapon went off in their client’s hands in what was a tragic accident.

Garcia Zarate’s attorneys said he had found the gun, which had been stolen a few days earlier from a federal ranger’s nearby parked car.

Steinle was shot in the back in July 2015 as she walked with her father on San Francisco’s Pier 14, near Embarcadero and Mission streets. Less than an hour later, Garcia Zarate, a seven-time felon, was arrested about a mile away from the shooting scene.

His previous brushes with the law and release by law enforcement stoked angry arguments over so-called sanctuary cities.

In March 2015, when Garcia Zarate finished his third federal prison term for felony reentry into the United States from Mexico, he was turned over to San Francisco on a decades-old bench warrant for alleged marijuana possession. Prosecutors declined to file charges.

ICE asked to be notified prior to his release, but city officials did not comply because Garcia Zarate did not meet their criteria, set in 2013, for turning over people to immigration officials.

He was freed.

A harsh light fell on what role San Francisco’s status as a sanctuary city had in the tragedy, with several Republican presidential candidates at the time calling for the federal government to punish such municipalities.

News outlets reported that politics and the immigration debate were kept out of the courtroom during the trial. The trial hinged on whether jurors believed the killing was intentional as opposed to accidental, as the defense asserted.

The prosecutor presented evidence that the pistol that killed Steinle required a firm pull of the trigger to fire and that Garcia Zarate threw the firearm into San Francisco Bay after Steinle fell, according to the San Francisco Chronicle. A crime-scene inspector also testified that the defendant had to have aimed the gun at Steinle for the bullet to follow the path it did.

“It was a verdict we were not hoping for,” San Francisco district attorney’s spokesman Alex Bastian said. “I know that both sides fought very hard, but again, the jurors are the ones who make a determination on a case and we will respect that decision.”

In an exclusive interview with the San Francisco Chronicle, Steinle’s father, Jim Steinle, and his family shared their hope that the verdict would mark the end of their public profile.

The family did not attend court to hear the jury’s decision.

Kathryn Steinle’s brother, Brad, went on to tell the newspaper that he was “stunned that they couldn’t even get him on using the weapon.”

San Francisco is a fucking cancer that's relentlessly trying to kill off all trace of common sense in this beautiful state.

I hope when that big earthquake hits, it will open up a giant chasm to separate batshit-crazy NorCal from SoCal, then there will be a legit geo-political reason to have California splits into two states, one for the loons and one for normal people.

In this case the killer has already been caught and nobody is expecting him to beat the charge. He will rot in jail and justice will be served.

So a tragic murder took place. The murderer was caught and he will be punished. The system worked. But too many people believe that it didn't in those other cases, which is why a presidential statement was warranted.
