If this a time for self defense that means te navy SEAL would be facing a situation where the other guy is drawing a weapon on him and therefore he is justified to use lethal force by shooting him. However if he were the one who approached a drunk and the drunk leaned forward and thrust his chin up at him in a movement that is clearly verbally arguing with him and he shoots him the SEAL will be prosecuted for his crime.

the bottom line that many cannot seem to get to is that what Shilling did does NOT qualify as self-defense. Those who think it does don't understand that legal definition; it's really not hard. Minimum needed to avoid bodily injury. Pro fighter punching shit out of drunk manlet doesn't qualify. It's called retaliation, and whether or not you think the guy deserved it is irrelevant. I don't know why some have such a hard time wrapping their head around that.
