LOL, no it is not a clear violation of the constitution. The FCC's job is to literally keep networks in check when they overstep. Networks are free to challenge them when they do. The FCC in this case didn't even file an official complaint. So I guess you are right in a way that it's not the same thing, considering the FCC didn't even officially do anything.

Violating FCC regulations is up to interpretation in most cases. It's why networks have fought them in the past, instead of folding like ABC did here. And those fights took place in legit legal settings. The FCC wasn't even officially involved here. A guy said some shit on a podcast.
