I don't even know what the presidency is as I don't look at such things on forums, so this is a slight side note, but if one manages to get banned from this forum with it's low standards I doubt one can be good at anything in life. It takes effort for a normally gifted person to even be carded.

Appparently, this prosecutor once used restorative justice in a robbery/murder and gave the defendant only 10 years after he punched an 87 year old Asian man in the back of the head during a robbery after the old guy went to an atm. This prosecutor felt that withholding a felony murder charge (25-life) was appropriate and that having the defendant meet with the family for 90 mins and give an apology and an explanation (restorative justice mainstay) for why he did what he did. Meanwhile, she is seeking a possible sentence of over 15 years for penny.

Yea if someone killed my grandparent like that there's no way I'm gonna sit there for 90mins unless we're locked in a cage together.

As far as Penny, if I was on that jury no one would make me vote guilty on anything. I don't care about the rest, dude likely was going to do legitimate harm to innocent people on the train if he wasn't stopped. And if dude let him go likely would have been attacked immediately. In that heat of the moment I'd be thinking about stopping him and keeping myself protected too.
 
If Neely had been white and Penny black, Fox News would have been playing that shit 24/7 talking about black violent crime.

I see an acquittal, but I could also see an involuntary manslaughter conviction.

He said in the police video that he had a green belt. He should know better then that holding a choke for that long could kill someone.

The video I posted shows how long he was choking. It's pretty long. I don't think he had any malicious intent and just wanted to protect people, but the law is the law.

But he also has a good case for self defense. You can argue self defense if it was for the defense of other people. All the bystanders who got interviewed right after, including the two black people said he did nothing wrong and the guy was a threat.

The jury wanted to see police body camera footage, Penny's interrogation video, and a bystander's video.

Yeah, I hate restorative justice. Like an apology makes up for killing someone during a robbery. His family should feel disgraced for agreeing to that. They actually said they forgave him. Wtf?

If penny is convicted and this da asks for a time even remotely close to the ten years that guy is serving for punching an 87 year old man in the head, there is no justice in the world. There is a huge difference from taking out a threat, accidentally, and attacking a very old man.

It is yea, pretty much. But if I'm on that jury with these circumstances that led to it I'm not gonna be responsible for him going to prison with someone else who is in there for manslaughter by drunk driving or someone by stabbing someone, let alone the hardcore criminals lol nah.
 
Here’s an article where da alvin bragg says that if there is a conviction it doesn’t mean there has to be a prison sentence and it will be up to the judge. The article goes on to say that there were multiple attacks on subways leading up to this event. It also had closing arguments by the prosecution where she said that penny didn’t see Neelys humanity and never asked if he was ok and thus, didn’t show remorse.
