Might as well make the same argument for imprisonment or any punishment whatsoever with that mentality. At the end of the day, we shouldn’t be structuring our society around unlikely scenarios that might make up a tiny percentage of the cases.Some people think the government isn't trustworthy, poorly run, and corrupt. So, perhaps giving it the authority to murder it's citizens isn't the best idea.
In blatantly obvious open and shut cases like this one, there is no good argument to be made for why these two shouldn’t simply be killed.
