You can seldom prove or disprove someone is racist or sexist or whatever. It's completely subjective.

AND this law sidesteps the requirement of proving "malice." Meaning you're defaming someone with the knowledge that it was false or with reckless disregard.

Completely goes against Free Speech laws.

Seems like a dumb law.

I could see something that's way more specific in regards to a false accusation of hate speech (ie someone claims that another person used slurs against them and then it's demonstrably proven to be a false accusation). This is absurdly vague and seems like something that's impossible to enforce.
 
The plus side is DeSantis old roommates law firm will be getting more work on my dime. Florida must lead the nation in laws passed that don’t have a single fucking prayer making it through court.

These accusations are subjective in the sense that everyone may have a different definition of what is and isn't racist. I do believe if you make that accusation, you should have to prove it. Nobody should have to "disprove" an accusation like that. That's not how America works. Unfortunately, these accusations are thrown around, now more than ever, with very little to no proof. They can effect someone personally and professionally, regardless of the authenticity of it. Whereas the person who made the accusation faces no consequences. This law is a good way to combat that, as well as the media abusing the "anonymous sources" to just print whatever story they want. As the Left loves to say, "Freedom of speech doesn't mean freedom from consequences." It's interesting how inconsistent they are on this principle.

If it can be proven by their actions that's one thing, but as you said if it's just a subjective opinion because person A disagrees with person B why else would person A call person B racist, sexist, etc. if not to damage their reputation?

Because they believe it to be true. There's no law against just damaging people's reputations.

A former partner or spouse can talk shit about someone to "damage their reputation" - like saying they're a narcissist and selfish. That damages reputations, but also completely subjective.

Defamation can be something like accusing someone of theft. When it is PROVEN to be demonstrably false, then that is defamation.

But you can't PROVE someone is not sexist for example.

This is actually accomplishing the exact opposite of what you claim.

This allows for the Florida government to push whatever racist, sexist, or transphobic trash they want without being able to be opposed.

There is no chance this will make it through the courts without getting laughed at. If this gets pushed through, then liberals will be able to sue Ron Desantis every time he calls them "woke" which would be unintentionally hilarious on their part
