What does the law state on this? Can somebody be found guilty for rape, when sufficient evidence exists, but without court participation of the victim?

I've never heard of a case in Ireland going to trial in such circumstances
due to the nature of rape - witness testimony is crucial
accused has admitted sex here to the the police, claiming consensual so it would need to be proved to be rape as DNA etc is not in question so testimony is VITAL

Given the brutal nature of the rape, given the damage to the victim, it could be proven in a court of law that it was not consensual, without victim testimony. Obviously it helps to have testimony. I would assume that if the accused perpetrator didn’t beat this woman and cause injuries that have been rumored, it would more difficult to prove. But, if she is as battered as is rumored, I would assume proving guilt is not outside the realm of possibility.

look I think that the case is credible
I'm just telling you 100% there will be no trial without the victim giving testimony outlining the details of how she was raped in court.

Yeah I’m not that familiar with Ireland law. I know it’s possible in the US.
I know I read of the recent case in Ireland about the lacy underwear being proof of consent. That doesn’t give me much faith that if the trial comes down to proof of consent, anyone would be found guilty.

Hmmmmm. I’m not a Conor McGregor fan (nor a Khabib fan) but I find it very suspicous that every report on this incident has been from someone with a long drawn out statement that includes so called “insider information” (I guess to validate the story). I know I know Ireland is small and “word travels fast” yet in the same breath you say names can’t be given until proven guilty. So a reporter would leak a document knowing the laws there? All of it is suspicious as hell. Also the American press would’ve been all over this story after that “leaked document” with Conor’s name came out. I just hope this is fake not because of Conor but because I hope this hasn’t really happened to this young woman. It’s bad if this story is a lie (which is seems to be) but it’s worst if it’s true because that means some poor girl was actually hurt.

it's not about innocent vs proven guilty
the discussion has been primarily about confirming who was accused.
we don't know who did the leak - presumably somebody in RTE - not necessarily a reporter.
for most of us the validity of that leak showing the identity of the accused has been confirmed.
guilt can only be assessed in a trial

Any updates today, brother? Ive just sobering up now - rough 36 hours here. Is the RTE leak verified or fake news? If RTE is indeed punishing the leaker, then we know it's legit, right?

On a few other forums someone (with another long statement about who they know inside law enforcement and blah blah) has certainly said a reporter leaked the document. The poster didn’t hint...he flat out said it was some reporter.....It’s unfair to the victim (even though her name isn’t given) and to Conor to leak a document. Because A) it could make the victim feel even more afraid knowing Conor is feeling the heat having been exposed in the media. And B) if Conor is innocent being put on blast before having a fair trial is bs. If this story is just someone starting drama and none of it is true, it’s just sad and hopefully will die down soon enough.

RTE have confirmed that the leak is genuine by reporting a data breach in relation to it under GDPR laws.
The long-running establishment the Times and Sunday Times of London have reported on this - they would not do that unless their sources are kosher.
It is Conor McGregor who is accused as per the RTE document
There was a rape reported.
Whether he did it or not remains to be seen.

I just got online and I've mostly been checking out the Heavies so I don't know much but I'm going to start looking around. I doubt that there has been anything breaking and there probably won't be for awhile.
And I think that the RTE leak is as verified as it is going to be for the time being. You don't report yourself to the DPC for a data breach if there was no data breach. It's just common sense.
And keep your chin up man, it's always darkest before the dawn.

I’m not muddying anything by simply sharing what I’ve observed. Every single person to first mention this incident mentioned that their inside information was from someone in law enforcement. And I find it suspicious that all the posts were drawn out in details about the credibility of their sources. And it was meant to seem as if it were a different person posting on each site. Yet all of them had similar long posts with similar “credible sources”. I’m simply pointing out the similarities because it’s suspicious. These are serious accusations being reported suspiciously.
