Almost every state has a Sales Tax and almost every state has an Income Tax.

Netflix is providing services to all 50 states and I would assume is filing Income Tax in all of the states. Which means they should be tracking their sales to apportion their income accordingly.

While consumption taxes are taxes on the consumer they are withheld and paid by the seller. If the seller doesn't withhold the proper amount for the tax authorities they are still going to be on the hook for the tax owed.

Whats preventing average joe from claiming he is from Timbuktu and thus not paying any kind of consumer tax?

I'd assume Netflix can see the IP.

I guess people could get a fake one but I doubt it would be a meaningful amount of consumers

Netflix isnt tied to an specific IP though. You can use your netflix account anywhere.

right but the majority of their clients use a credit card for payment -- so the card billing address has to match the billing address of the client -- so if your CC address is listed in a city that has the tax, they know to implement it -- regardless if you are using the service in the city at the time.

I don't know about the Netflix tax but we pay 8% in Sales tax.

And again the state has to allow it. But in reality when a city charges more in Sales Tax it's almost always regressive since the people that have cars tend to go do most of their shopping in the suburbs, NJ or TAX FREE Delaware as a result.

So the only people who end up paying substantially more in Sales Tax are poor people who don't own a car. The same goes for sin taxes on cigarettes and soda.

Im not arguing the merit of collecting taxes, merely the practicality of doing so.

I guess since netflix is cheap nobody will go through the lenghts to avoid paying taxes for it.

I can tell you now that as a Californian, I would not even consider jumping through all those tax-dodging hoops to save 94 CENTS each month on my Netflix bill, and frankly I don't know anyone who would.

If I live in a corrupted country where the government charges an insane 100% Value-Added Tax that doubles the service fee or product's sticker price and have no plan to invest it back to the country, then may be.
