Purchased some counterfeit merchandise that was advertised as authentic. Had an off feeling about it and didn't know for sure until later :(

Wondering if anyone knows the process for small claims court and what you need to file a claim.

If you bought online, you aren't going to be able to collect from a merchant out of state.
 
Craigslist, Canada. If it was online I would just get a refund from paypal.
 
sell it for a small loss to someone else to recoup some money back
 
File your dispute with ebay/paypal
this. saves you the cost and drama of engaging in court - you would also have to pay for service, track him down, get evidence, etc. They have insurance for these incidents.

ebay/paypalcan use their resources to remove him as a member and seek remedies against him if they feel like it - as he is damaging their company's goodwill by using their service to defraud.

edit - looks like you did it through Craig's List, well, good luck with all that. Dodge people are notorious at being difficult to track down.

Call the police and report him for selling counterfeit goods.

And then call the company that makes the goods and tell them too. Maybe they will sue him and brankurpt his ass.

Police don't really do anything about small stuff like this. The threat of it is worse than it actually is.

I don't think a sunglasses company would bother trying to sue one person for selling a fake pair on craigslist. A big company selling thousands is a different story.

Contact the seller asking for another whatever you bought. Beat him up. Post pics.

well, in that case. sounds like the remedy you want isn't really held by civil courts, as it's not about money, rather the criminal ones, in which case, reports to the police and let them figure out if they want to proceed. They may end up dropping it depending on the threshold tests they have there.

Or, you could give him a call, he may not know it's counterfeit and he might make it right.
 
My girl sold a purse of hers on Craigslist one time. Her and the buyer agreed to meet downtown at a busy place, but I went with her just to be sure and we used my E-mail address with my name just in case.

When the guy walked up, he looked at the bag and immediately flashed an FBI badge and explained how he knew it was real, pointing out different markers on the bag. We were like yeah guy, we know it's real. He bought it and continued to talk to us about what a big shot he was until we politely excused ourselves and left.

When I checked my phone later, I had a new E-mail from him saying that if I wanted, me and him should hang out sometime.

I've never used Craigslist for anything again. True story.

I texted him a couple of times. He keeps claiming they're real and to go to the store to check and it's not his fault I don't like them :icon_lol:

I asked him if he would give me my money back after I confirmed with the store that they're fake and he did not reply obviously.

if it's just you, yeah maybe, but if it's more than that, they're more likely to move on him.

Pair of sunglasses. He listed it for 350 obo and I offered 300 and he went down to 310. Scummiest thing is the guy offered to shake my hand before he scammed me.
