Crime 16 year old Swedish girl raped by eritean immigrant, immigrant not deportable because "rape didn't last long enough"

Hmmmm... I'm thinking there's more to this story. You folks on sherdog are really willing to go along with whatever fits your narrative. If you thought for one second you would be suspicious of this.

Sadly I can only find extremely partisan reporting on this, no actual news reporting.

Interestingly this guy was initially acquitted of the crime, as there wasn't enough evidence to prove it, but than faced double jeopardy and convicted by another court. Supposedly in Sweden you can keep trying someone until you find a judge or jury to go along with you.

There's definitely more to this. Maybe he's guilty and deserves to be fed to the pigs, but he could also be innocent and a victim of a witchhunt in a politically charged environment. It could be, if the later is true, the judge making immigration decisions agreed with the lower court... maybe the judge isn't a "believe all women" type and actually thinks there should be evidence.

It is not up to the judge to determine guilt or not. The person was deemed guilty so the judge has to give the appropriate sentence for the crime.

Well, if true, it's to the surprise of absolutely nobody

I hope everyone upset about this is as furious over the Brock Larson case and every other instance of a sex offender getting off easy.

Fuck this guy and fuck em all.

It’s a different discussion as this is about a rape that can be prevented by not letting certain people into your country, while others have nothing to do with that process.

Got it. You’re only upset about sexual assaults by “those” people.

Absolute clown shoes.

A Swedish court has ruled that the Eritrean migrant who raped 16-year-old Meya Åberg won’t be deported because the rape didn’t last long enough. The rape took place on September 1st last year when Meya missed her bus and was walking through a pedestrian tunnel after finishing her shift at McDonald’s. Meya and her family immediately reported it to the police.

The 18-year-old Eritrean migrant, named Yazied Mohamed, was sentenced to 3 years in prison for rape. Mohamed is a citizen of Eritrea, and the prosecutor sought his deportation. However, the Court of Appeal noted that the man has refugee status. Under Swedish law, deporting a refugee requires that the crime committed constitutes an “exceptionally serious offense” and that allowing them to remain in Sweden would pose a “serious threat to public order and safety.”

The rape of 16-year-old Meya was not deemed serious enough to justify deportation, with the Court of Appeal citing, among other factors, the “duration” of the rape in its assessment. “Rape is, in many cases, considered an exceptionally serious offense that could lead to the deportation of a refugee, but an assessment must be made based on all circumstances in the individual case.

Given the nature and duration of the offense in question, the Court of Appeal finds that while the crime is serious, it does not constitute an exceptionally serious offense that would warrant a deportation order for Yazied Mohamed. The request for deportation is therefore rejected,” the Court of Appeal for Upper Norrland wrote in its ruling.

And the problem appears to be larger

The same logic could be applied to you in the reverse. Why are you talking about the Brock Larson case from years ago, if not to deflect away from this case, because it's about one of "those" people? Where would the assumption that nobody cared about that case even come from, if not an inherent bias about the motive to talk about this crime?

If we were to look at that thread about Brock Larson, I highly doubt we'd find any posts of yours asking people to share the same outrage over some unrelated crime involving an immigrant from years earlier.

Oh, someone implied racism, everybody stop what you're doing.

Yep, thread over. Not like it’s a legitimate discussion of policy or anything. How one rape is preventable by sound immigration policy while another isn’t.

These people think Eritreans are every bit as Swedish as Swedes if they just happen to be there. So any crime by them should be approached the same way when not letting them into your country or kicking them out of the country is a prevention measure not available for an actual Swede who may commit a crime.

That goes for Larrson as well.

It’s not assigning “seriousness” to the crime. Thats what these Swedish judges were actually doing which Gabe is deflecting from. But there is a clear policy prescription available for foreign rapists in prevention and punishment

well you not even getting the name right of the guy whose deeds you're supposedly upset about surely gives credence to the honesty of your sentiment.

No... you missed the point entirely

He avoided deportation because he came too fast raping that girl

Rape is rape... why would the duration have any bearing on it? Why would you want to allow someone who has already committed rape to eventually become a citizen? I'd deport white guys here in the US to Afghanistan who committed if the law allowed. Race has zero bearing on it. Would you trust this man to be alone with your teen daughter? No? Kick him out...
