This seems to sound like Giuliani (shocking!) misstating the law in terms that are comforting to Trump's position

(CNN)Special counsel Robert Mueller's team has informed President Donald Trump's attorneys that they have concluded that they cannot indict a sitting president, according to the President's lawyer.

"All they get to do is write a report," Trump lawyer Rudy Giuliani told CNN. "They can't indict. At least they acknowledged that to us after some battling, they acknowledged that to us."
That conclusion is likely based on longstanding Justice Department guidelines. It is not about any assessment of the evidence Mueller's team has compiled.
A lack of an indictment would not necessarily mean the President is in the clear. Mueller could issue a report making referrals or recommendations to the House of Representatives.

Mueller told Trump's legal team he will not indict the president, Giuliani tells Fox News

President Trump's attorney, Rudy Giuliani, told Fox News on Wednesday that special counsel Robert Mueller has told the president's legal team he will follow Justice Department guidance and not seek an indictment against Trump.

Giuliani, himself a former federal prosecutor and mayor of New York City, also told Fox News that Mueller's investigators have not responded to five information requests from the president's team. That has forced Trump's legal team to push off making a decision about whether the president will sit for an interview with the special counsel -- a decision they had hoped to reach by Thursday.

The precedent that federal prosecutors cannot indict a sitting president is laid out in a 1999 Justice Department memo. Giuliani told Fox News that Mueller has no choice but to follow its guidance.

"This case is essentially over," Giuliani said. "They're just in denial."

Not = indiciting =/= not listed in criminal complaints

Mueller could list tRUmp as an unindicted co-conspirator. This would remove tRUmps pardon power while also listing tRUmps wrongdoings

There's so many levels to this that those who are the subject of the investigation have NO CLUE what kind of buzzsaw they're walking into. They don't know who's talked, they don't know who's flipped, they don't know who's phones are tapped, they don't know who's wearing wires.

It's full-on paranoia all the time in the WH and it's insane that we chose these people to lead.
