Since Pruitt would be changing agencies he'd need new confirmation. If an undersecretary or DAG was promoted in the same agency they got confirmed in they could be "acting" in the role for a year without new hearings and confirmation.

There does seem to be a grey area where if a cabinet vacancy opens up unexpectedly a previously confirmed secretary can be moved in temporarily for up to 210 days. HOWEVER the gray area is if "being fired" is an unexpected vacancy. It's meant for deaths or unforseen resignations to allow government to function properly in what could be an emergency (say Sec of State was assassinated). So the issue here is firing vs resignation. If Sessions refuses to resign and forces Trump to fire him than Trump can't slide in Pruitt because Trump could have planned for this opening and had a replacement ready for confirmation process.

Also Pruitt would be jumping in headfirst into Mueller investigation and obstruction charges himself if he did try any of this.

I disagree , I think their best bet is to try and hold off til after the midterms, if they do it now even more of their base will stay home .
