Woman sues Starbucks over too much ice in drinks

First, people were suing because their coffee was too hot. Now, it's got too much ice.

An Illinois woman has filed suit against Starbucks for $5 million over the amount of ice the coffee giant used in its drinks.

Stacy Pincus filed the class action lawsuit against Starbucks Corp. in Northern Illinois Federal Court Wednesday, according to court documents.

Pincus' suit says because of the amount of ice Starbucks uses in their iced beverages, customers often end up with half of the amount of drink that is listed on Starbucks' menus in fluid ounces. The suit alleges that Starbucks is purposefully tricking customers into paying for more product than what they are provided with.

"The word 'beverage' is defined as 'a drinkable liquid.' Ice is not a 'beverage' by definition. Accordingly, Starbucks actually gives the customer much less beverage in the cold drinks they order and pay for," the lawsuit says.

Meh, seems legitimate. If I'm paying $6 for a double-iced-frappe-a-lap-a-chino it better be the correct number of fluid ounces.
 
On the surface it sounds ridiculous, just ask for less ice? Or does Starbucks deny such requests? You would think there is no way she wins this lawsuit and yet she just may because our legal system can be wacky.
 
It's a class action thing, not some woman claiming $5M of emotional scarring due to frappucino ice. Gotta keep Starbucks on the up and up. Sounds dumber than it is.

To my knowledge, it's never actually stated that you get X number of ounces of liquid, but that you get whatever you get in a cup of a certain size. We've always known that more ice = less liquid. That's true whether it's Starbucks or whether you're getting a Coke at McDonald's.

Here's what I think is funny: These people would rather sue the company instead of "voting with their dollars" and simply refusing to patronize the place.

I think the boycott is far more noble and democratic, in that it keeps the power in the hands of the people instead of turning to Big Brother for help. And yet, it's a very underused tool.

She isn't suing for $5 million for herself. It's a class action lawsuit and anyone who has bought iced coffee at Starbucks can join it for a piece of the pie, or sip of the vanilla latte, as it were.

Still dumb though.

Agreed, easily solved by just getting your coffee somewhere else. I said it's not as dumb as it first appears. Doesn't mean it isn't dumb.

If enough people did it, Starbucks would change the way they do things. I guess the difficult thing there is getting enough people to join in.

No, Starbucks doesn't deny requests for less ice. I would think that would be the only way this really holds up.
