The disc golf gods were just and kind today. They allowed me a 200 foot throw-in, but in return demanded the sacrifice of my favorite custom dyed disc.

Was debating making this a thread but it won't have any traction. You'll have the boot lickers and then a bunch of "all cops must die" assholes bickering again.

Miranda Rights. If you're an American you've likely heard OF them, and seen parts of them said on TV shows at some point. I'm sure Canadians and other nations have versions of this.

That said... CAN SOMEONE who is drunk actually be Mirandized? You can't give consent for sex (in most places) if you are intoxicated.... so can you confirm you actually heard and understood those rights as read to you?

Yes. It's the same as legal culpability attaching for a crime committed while drunk: voluntary intoxication is essentially a step in whatever action is taken afterwards. I've only seen the intoxication defense used with regard to the ability to informedly waive Miranda Rights, not to receive them, and I don't believe it was successful.

Considering it happened during a livestream, it's too bad for him that he didn't die. It would have been so lovely for him to have died doing what he loved: talking out of his ass.

I haven't seen the issue often. So, considering how often drunk people are arrested and searched (like in DUI situations), I would guess that it's an argument that courts just don't entertain because of the obvious complications and the implausibility of having any kind of workable standard.

Also, just in general, it's pretty rare for Miranda issues to be successfully brought up in criminal defense. You would need to flagrantly, inarguably not understand just as you need to flagrantly, unambiguously ask for an attorney.

This might be something I might ask one of the attorneys I work with about. Just figured I'd come here first for a consensus take on it so to speak.

I still can't get over how much Utah fucked over the Natives here.

Almost all of them had resided in the Salt Lake Valley (primarily near, holy shit, the Salt Lake as well as what is Utah Lake the freshwater one just south)...

Mormons show up, kill off a ton of them, and then ship some off to a tiny reservation in Tooele and then shove the largest tribe the Utes with a bunch of others down in like the Southeast corner of the state. Seriously, there's like 7 different tribes on that reservation.

I know Wind River has it's problems but at least it feels like Wyoming they allowed the tribes to be to themselves rather than sticking groups that might not have gotten along on the same areas of land.

Well, Mormon religious teaching isn't exactly, uh, kind to Native people so it shouldn't be that much of a shocker bud. I mean, if you believe someone has red skin as punishment by god, then it stands to reason there's not gonna be much barrier to death and dispossession imo when you're white and they have something you want. And putting conflicted tribes in the same space was done all over the country. It was both an efficient use of minimal land space, as well as a deliberate strategy to prevent inter tribal cooperation and to use various Native groups as a means of policing each other.

It's ignored because it can be ignored. As far as I understand it, there's literally zero cultural or political pressure to pay any attention to tribal issues. Ever. That state is locked down values-wise. It's much different in the PNW, where Native people and advocacy groups have been somewhat successful in maintaining a degree of visibility throughout history. And given the particular nature of tribal resource management and numerous legal battles over treaty rights, there's really no way to completely escape tribal issues. Oregon, for example, was one of the regions most heavily targeted during the termination era and therefore Native people here have spent the following decades being as loud as possible about everything that occurred as a result.
