I would say most likely Biden had ni idea what was signed and most likely never knew about it. Members of his staff used it.
Proving it is a whole different process. I would think it would be very hard to do unless one of Biden's staff came forward to testify it happened. I don't think that's going to happen.
He was in the Virgin Islands on vacation at the time. I am sure they could easily produce a communication transcript or at least time log of them asking him about it.
