Economy Supermarket destroys food, does not let people salvage them

Did you read the article? It doesn't mention anything about the items being expired. They were throwing out perishables that couldn't be refrigerated because the store had lost power during a winter storm.
Yeah, because it goes bad if it's not refrigerated. The expiration date printed on the packaging does not apply if it's something that is supposed to be refrigerated but is instead put in a dumpster.

It was colder outside than their refrigerators.

Unless the food was spoiled before discarded (not likely, and not mentioned in the article), it wasn't going to spoil quickly in the low temperatures.

To be fair, this is different and is kind of dumb on it's face. It's all legal bullshit. Way back I had a girlfriend who worked at a doughnut shop, and they would throw garbage bags full of perfectly fine food out every single day, and their dumpsters had their own secure little area on top of being under lock and key. Their dumpsters were more secure than the goddamn store itself, all to protect their garbage.

It's all about liability.

Giving away expired food is a recipe for a class action lawsuit...give those bums expired food...

This is the exact opposite of what happened where I'm from back when the pandemic broke out, and there was a ton of leftover meat, produce, and dairy products. It was all being given away for free.
 
Sounds like a pretty shitty thing to do. But naturally, since you are posting it , there has to be something left out that would crush your argument.
 
To be fair, at least in my store, they invite reps from a homeless charity in near the end of the day's trading. They get first pick of the stuff that would otherwise be thrown away.

They can do with it what they want because that's what the law currently says.

We can always change the laws.

You can have the plaintiff pay for you legal costs in a frivolous lawsuit. You can also have the lawyers that filed the suit punished and even disbarred.

I'm not going to support a law that tells a person what they have to give their property away.

If you want to encourage the giveaway then protect them legally making it hard to sue them and maybe give them a tax write off for it.
 
There is liability if someone were to get sick from any of that food. The people may be hungry but let one of them get sick and they would sue right away.

Their liability is EXTREMELY limited. There is a lot of case law around this, all the way up to the supreme court. According to a 1988 Supreme Court Ruling (California vs. Greenwood), when a person throws something out, that item is now the public domain.

In other words, the second it hits the dumpster it's not the store's property anymore it's public domain. So they aren't responsible for food poisoning.

With that stated, trespassing laws do apply while the dumpster is on their property. Trespassing in a publicly accessible space does come with it's own set of laws. Walking into a partking lot that's open to the public is almost certainly not trespassing until you are specifically asked to leave.

Dumpster diving liability questions are so common, that the synopsis below is from a personal injury lawyer's website.

LIABILITY ISSUES ARISING FROM DUMPSTER DIVING

While many business owners are concerned that they can be held responsible if expired food or similar goods in their trash cause harm to a dumpster diver or if a dumpster diver is injured on their property, this is not usually the case. Unless the business has been negligent, they should not be responsible for a dumpster diver’s injuries or illness as a result of eating or using items that have been thrown away. - Source

These responses make me lose faith in humanity. This is just yet another sign that America is collapsing, complete disregard for the well-being of other Americans. I always grew up thinking that people in the states cared for one another but once I became older I realized this hyper individualistic attitude in America is so destructive. The pandemic really showed peoples' true colors and in some ways I'm thankful for it because it made me realize who is worth keeping around as a friend. There shouldn't be anyone supporting this. Not in a country as wealthy as America
