Sent to Collections by Former Employer

Had this happen to me. The owner managed the payments/bank accounts from his home computer.

Called me to meet me and exchange the pay for a carton/crate/pack of beer.

I didn't. (He replaced me without notifying me after i called in sick late one time)

2 days later i had a brick through the back of my car window at my house.
Worked out to come out about $50/$100 on top after replacing the back window.
This is Australia though. It may work differently where you are.

Reality is I've experienced it.

That doesn't change the fact that his employers are legally entitled to reclaim the funds if they did in fact overpay him.

I can never understand people who ask for help on here, but then they don't answer questions necessary to help them out. I don't know how many people have asked if they actually did overpay you. Did the company try to contact you prior to collections and you just ignored it like everything else in here? Probably.

They cant bring that to collections. let the collecion agency know you dispute it. Thats a civil court case, not a case for a collection agency. and when you go to court tell the judge your boss told you youd get a bonus if you did a good job.

If you don't mind me asking, what was the name of this supposed collections agency?

I ask because last week I got a very threatening call from an agency that claimed I owed over $900 in fees for a gym membership that I cancelled after I moved. I was able to get them to give me a contact number because I told them in the initial call that I knew I had cancellation paperwork. Little do they know I'm actually friends with the owner of the gym. I spoke with my friend and he said I wasn't the first person that has had this happen--this faux collection agency somehow got ahold of clientele records for at least this gym (he owes a location of a franchise gym) and has been trying to scam former members.

Any legally inclined posters--would I/he have any sort of legal case against this collections agency?

Only if they had some goofy contract could they collect, payment is like a speed limit, a minimum. Could I do collections against a waiter because I decided i ovepaid at a later date? Thy have to show some really good proof of an error and your knowledge of the error in court to get the money. Not some crap where out of the blue thay say "oh he wasnt supposed to get that much" You were working as hard as you were getting paid, they cant go back retroactively. you may have done half the job if they had been paying you less.

I've had experience with debt collectors. They literally have no power except to bug the shit out of you until you give in. If you ignore them for long enough they will go away. Unless the company takes legal action, there is nothing they can do. Unless it's an unreal amount of money, most companies will not want to spend the resources to get the money back. I would either ignore them or get a lawyer to tell them to go eff themselves. I seriously doubt there is anything the company will do about it.
