Question for you homeowners. Will the town catch me? (Cliffs inside)

Seems that many posters don't know what a cesspool tank is.

It absolutely would here, but I don't know your market. It depends on how well staffed your department is and what their priorities are. Our zoning department is bombarded with building permits, complaints from citizens, zoning issues, etc. Making sure someone has a septic is very low priority and not really monitored. But again - that's why I asked if someone notified the department of your sale with no septic. I would assume that would have to happen for them to be able to even try to monitor it. And on top of that, when you do it, were you instructed to inform the zoning board?

What makes you say that? Is there a requirement or recorded doc to prevent the sale without notification?

In real estate, there are a shitload of laws that get passed that do not get enforced. Indiana code says you have to do several things when you sell if you are in a Homeowner's Association such as produce a statement of HOA dues to buyer, provide copy of covenants to buyer, provide any additional HOA restrictions to buyers, etc. No one does it, and who the hell is going to enforce it? Another is that the plan commission has an ordinance that says any split must have the survey recorded. Well split approval is done prior to recording, so people don't record the survey. There is no enforcement.

Your situation may be very similar. It's honestly a stupid rule to not have it as a requirement to sell as it makes enforcement much more difficult.
 
One thing just popped into my head - do you need to go to zoning when you do the septic? If so, they could research you then and hit you with the fee. That'd be the easy way to enforce that.
 
I bet you could delay. I've never heard of a city fining you for something right away. Almost always they will give you a warning first, so I don't think you are in danger of a fine necessarily.

However, they might give you a very short time to remedy things so keep that in mind when you consider your financial position.

Even if they try to hit you with a fee when you ultimately build the septic tank late, I bet you could negotiate it down citing financial hardship or something similar.
 
All I can think of is TS bought a house next to the Kandahar Poo pond...
