It depends on your definition of "smart." Functionally, no, he's pretty bad and seems to genuinely consider posters like Palis, ripskater, uppercutbus, and TCK to be solid political minds. But he himself has well-above average intellectual abilities and could be an intelligent person.

It was as clear a judicial policy-making holding as ever existed (well, second tier, after Janus). It flied in the face of stare decisis and (especially) judicial restraint on completely dishonest faux-originalist grounds. It was a great example of how originalism is pure hackery tbh.

And that's regardless of whether one supports the policy or not. I used to support it, but I no longer do (I would support a limitation on the federal government stripping individual ownership, but certainly not on the states). To say, all of the sudden 200 years later, that all these policies that had gone on for decades and were upheld (or passed over) by the Court were unconstitutional and incompatible with the original meaning? It's genuinely comical.
