Let's say we played word association and you said "criminal" to which I replied "black person" would you think that was racist.

There are no laws that are racist. Does not exist. Therefore who becomes a criminal is not racist. There is not something about being black that makes them more likely to be a criminal. Being statistically over represented does not equal racism. Is tennis racist? Is the NBA racist?

How about Obama's jail pardons, were those racist? Did he have his numbers be statistically representative of the population?

The Fair Housing Act doesn’t include criminals as a protected class, but the Department of Housing and Urban Development (HUD) says refusing to rent based on a criminal record is a form of racial discrimination, due to racial imbalances in the U.S. justice system.

“The Fair Housing Act prohibits both intentional housing discrimination and housing practices that have an unjustified discriminatory effect because of race, national origin, or other protected characteristics,” say HUD’s newly-released guidelines. “Because of widespread racial and ethnic disparities in the U.S. criminal justice system, criminal history-based restrictions on access to housing are likely disproportionately to burden African-Americans and Hispanics. Not in the way you mean. You can still refuse to rent to either. You just need a basis for doing so beyond "he once done a crime." It's essentially an announcement that if somebody consitently uses the criminal status of a potential renter to refuse to lease, but applies this policy in an unreasonable way (e.g., by only enforcing it against black criminals, or not taking other factors into account in a reasonable way), this may be considered either discrimination or a pretext for discrimination. It isn't really anything that hasn't been done with other areas, but TS saw "Obama" "race" and "criminal" and started frothing at the mouth.

The issue the obama administration is concerned with is called "pretext." It's using a criteria that matches unto certain demographics to disguise intentional discrimination.

i would defend not wanting to rent to a marijuana user. the people below me smoke pot all day, every day. naturally, the entire area smells like pot all the time as well. i know that all the pot proponents in here would never guess it, but a lot of us don't really care to live in that environment. it could easily hurt rentals if i were to go show a potential renter an apartment and as i walk there, we are greeted by that smell
