Should be no case to answer. You break into someone's house, and put them in fear of their lives by brandishing a deadly weapon, you deserve everything you get.:icon_evil

If the video is correct no charges should have been filed but it's NY so the right of self-defense and duty to retreat is much stricter, no castle doctrine.

Thats what its looking like more and more with every case that comes out. Now if someone breaks into your home instead of simply defending yourself you have to try and play detective or police officer first. You have to determine if the intruder is armed and even if he is you still have to make sure he is going for the gun first. Otherwise you are expected to either subdue the suspect with your bare hands or run really fast.

Pathetic that this charge is even considered in this country. Scumbag thieves are beginning to have more rights than law-abiding citizens and our government is happily ready to protect them to ensure our rights are slowly eroded away while theirs only grows and grows.

I read the homeowner didn't even offer his intruder/guest a beverage or appetizer. This animal needs to be removed from society asap.

In saying that though the law shoud be altered so that once the court proves this guy was just defending himself , the family of the scumbag he killed should have to give the guy some cash for his inconvenience.....poor guy had to waste a perfectly good bullet on a shitstain.

I had assumed the guy was shot while inside the home or was just outside as the fighting continued not the guy chased him down and then shot him.

The intruder died in a car but he could have been shot on the property and just died in the car.

The link is not clear but you are lead to believe the shooting happened inside the house as a return fire situation.
 
tbh it really doesn't matter to me whether the intruder was shot in the house or while trying to flee after breaking in. Once you break into a house, you've kinda waived your right to not be attacked imo. The consequences will never be the same.

Yea I'm not so supportive of chasing the guy down the street in a running gun battle. I don't care about the shit head that broke in but it puts too many other people at danger.

That is sick... We have a similar retarded law in my country.

I can't even understand the logic behind that law or why that law exists does this benefit the people in power the only one who will benefit from that absurd law are the criminals the Rapists,Child Molesters, etc,

That law is just empowering criminals

BAD GUY1: " Hey I guess we can enter Mr.Smiths house he got a cute 16 year old we can rape"
