Except for the fact that the alleged victim has already changed details of her story, and in cases where it's he-said, she-said, credibility is the most important factor.

She previously alleged that he picked her up and slammed her on the concrete; at the hospital she says that he threatened to push her into the pool, she ended up grabbing his arm and falling short, landing on the ledge instead. The medical staff at the hospital are also on record that the reportedly broken hip wasn't proven.

The fact is, she initiated the physical confrontation and Diaz' lawyer can argue self-defense and this is one way he could do it: she threw an object at Diaz, he restrained her, and he then threatened to push her into the pool if she didn't calm down, she didn't calm down so he pushed her into the pool. Character witnesses could further discredit her credibility (some have alleged that she was looking for a way to get Diaz imprisoned) and there's also a video online of her ranting and raving over Diaz saying that she hates him (which could point to motive for framing Diaz).

Weed vs Coke and booze are very, very different. I don't think the post up two from your was saying that we'd made you violent, but it is true that certain drugs, ESPECIALLY BOOZE, can make you do some Wild shit. I live every some drink but I have done some of the stupidest shit of my life while drinking - also see The Ultimate Fighter for evidence of how regrettable alcohol can make you act. If I were a conspiracy theorist, I would almost surmise that alchohol is the one hard drug that is legal because it fucks people up the most (not to mention does the most damage, is the most addictive and changes e brain the most),

Diaz is gonna force himself to fight because he is facing some serious time .. And if he doesn't do it now he will lose the chance forever ... I'm sure his lawyer bills are gonna be pretty hefty
