But seriously, we would be wrong to suggest that judges could somehow be held liable for criminal's behavior when they are working within the legal guidelines they are afforded.

The ways this is handled:
1) Legislation at the state level for mandatory sentences for multiple previous offenses.
2) Better selection of judges and removal of bad ones that make unconscionable decisions.
3) If the state has propositions, they can have a citizen vote for something like a 3-strikes law. Texas doesn't have public referendums, but some states do.

What the governor can do is push for legislation that fixes this problem.
