They've already explained that the retired fighter thing is meant to apply to fighters who retire while the UFC is undergoing USADA testing. Brock retired 5 years ago. It's fine. Complain to complain.Except it's not an "exception" for new fighters. They're just choosing to apply the new fighter rule to Brock, even though he was already in the UFC at one point and his return completely violates the USADA agreement that returning fighters need to undergo mandatory random drug testing before being cleared to fight.
That's the controversy, not that he hasn't been tested. They can bring in a new fighter at any time for a short-notice replacement (i.e. Joe Soto vs Killashaw or Pat Cummins vs DC) without the screening. It's retired fighters who need the extra testing so they don't "retire" and use PEDs for 6 months and avoid drug testing and then cycle off and come back.
