That said, against 99.99% of American jurists, I feel that Marbury v. Madison was wrongly decided, and the judiciary is not entitled to ‘second guess’ executive decisions like this.

Some might say this is just a craven attempt to puff myself up for securing a district court nomination. I’m not going to say it isn’t. But I, for one, hail and approve of our new administration.
