He can order the DEA via the AG to reschedule cannabis, so yes he technically can. However, Trump cannot create a framework for cannabis to be sold, taxed, and regulated; that would be the responsibility of Congress. Of course, there's no chance in hell that Trump would just legalize it without giving the government a way to profit from it, so we're stuck waiting on Congress for this one.

Yes. That's what I was getting at in terms of full legalization. Rescheduling to 4 or 5 would still leave it subject to regulations under the CSA. Actual legalization would require Congressional action, which is very unlikely to occur, imo.
 
President Trump is playing 4D chess he wants Democrats to react to it. They need to avoid falling for it. They need to continue talking about fair wages, healthcare, infrastructure spending, jobs, budget, military overreach. Most Americans already know he is drawing in the Democrats.

This does 2 things

1.) Takes any wind out of the Dem win of the house by eating news cycles
2.) Lets him put in a cronie that will kill the Russia investigation and obstruct anything the Dems try to do
I'm speculating a bit here, but I think the timing is due to the possibility that Mueller has some real deep shit to reveal and he's prepping to fire him.

I'm not sure how much #1 matters. I agree with you that Trump wants to dominate news cycles and doesn't want to hear about the loss but I would say who cares, let him have it. Democrats have now taken real power and the ability to investigate Trump and the GOP and stop their agenda dead in it's tracks.

Sessions being fired is no great loss to the country. With the democrats taking the house though, is there any real way for Trump to stop or limit an investigation into charges of corruption? It seems like the best time to let him go, maybe you buy a few months with the heat off before the new Congress is seated.

Now, keep in mind that the new AG can only fire the special counsel "for cause", with which it being an active criminal investigation, could be found to be Obstruction of Justice if that "cause" isn't...causal enough.

Bold strategy, let's see who gets arrested.

Luckily any substantial changes and any reasoning are subject to House subpoena power. It's a quick way to give the optics of guilt and depending on any testimony, the confirmation of guilt.

Assuming Whitaker decides to put a halt to Mueller and the House picks it up, the endless talking point will be about a Dem majority investigating outside the scope of the DoJ. It won't be rational, but they'll cry foul.

Firing Sessions pre-midterm would have been the catalyst to upwards of a million people taking to the streets, possibly effecting a senate shift in what (ultimately was) a safe year for Republicans. Democrats are already fired up, that would have made them vote come hell or high water. With the margins some of these senators won by, that's a dangerous proposition.

Now, you still have that same probability of mass mobilization, but 2 years until the next election. It's a calculated gamble that may or not pay off depending on what Mueller already knows.

The Dems control the House of Representatives now and have more resources and leverage to keep pushing the Russia investigation. So things just got a bit worse for Trump which is why hes throwing all the cards on the table now.

Which is why it's such a gamble. Make any big changes to the scope, funding, or timeline of the investigation, and congress gets wind of it. You're talking about entangling people in a conspiracy here. This is literally what the resignations in the Saturday Night Massacre were attempting to avoid.
