The republicans on the intel committee have released a memo bitching about a FISA warrant saying it was based on a shady file from a shady source and this was not disclosed to the judge.

Republicans are accused of giving a factually incomplete and incorrect account of the application by the Dems and the FBI. The Dems however have been muzzled by the republicans from releasing their side of events.

99.7% of all FISA warrants are rubber stamped suggesting that abuse may be wide spread, but somehow that abuse may have occurred in this case, makes it worse than watergate.

None of this changes the fact that the Mueller investigation is warranted becuase hippopotamus.

I suppose I agree but the problem is that it puts presidents at the mercy of the deep state with no recourse. And given everything we've seen the past year with this Russian conspiracy and the bi-partisan effort(at least at first) to push this thing there is no reason to think Trump would have actually survived had he not been able to choose his own people or even fire Comey. Remember you got republicans like McCain and Lindsey Graham and a whole bunch of never trumper republicans who were going after him to.

A ‘source’ (aka FBI) informed The NY Times that a FISA warrant was issued against Page back in 2013. You can read that claim in The NY Times annotation of the letter.

Most likely the FBI has been tapping the guys phones for years, and recycling the findings against him in subsequent applications. Nothing to do with Trump.

But this is not easy for them to explain as a defense in public! ‘It wasn’t Trump because we have already been spying on him for years, without any charges!’ Awkward.

I think the initial investigation started in 2013 but the initial FISA warrant wasn't obtained until 2014. Regardless, its incontrovertible that the FBI's knowledge of Page's contacts with Russian spies played a role in the request for the warrant in question in Nunes' memo. He traveled back to Russia for several weeks in the summer of 2016, during which time he was associated with Trump's campaign. Even if most of Steele's dossier was salacious garbage , the investigation into Page and Papadapolous would be enough to get another warrant for Page (after he left the Campaign, coincidentally).

Of course, the public has no idea at the current moment how much of the contested warrant application was based on discredited portions of a single dossier. It's unbelievably specualtive.

And of course, Nunes and Trump won't release the underlying information regarding the warrant because they're hiding behind "sources and methods". They've basically released a biased, unsubstantiated, speculative memo that can't be refuted because the information on which it's purportedly based will never become public.

Hell, Nunes admitted he hasn't even read the FISA application. He never read it. Period. Gowdy did. This whole thing is a concocted circus.

The problem is that contempt is for failure to comply with an order of the court. (or actively disrupting proceedings etc, but lets not pretend that it fits there either). This is an application for a warrant, not a response to a court order.

But maybe you can prove me wrong. Why not dig up some cases where a cop or prosecutor was imprisoned for contempt of court because they didn't disclose something to a judge when applying for a warrant? Or some similar action, I'm not too picky.

The Schiff memo hasn't been muzzled. It's just being put through the same review process the Nunes memo went through. National security remember.

Those who sign for the FISA app sign a sworn declaration. This means they can not with hold information. If they did not TELL the judge the real origin of the Dossier they breach that declaration

If at any time they found out LATER the true origin of the Dossier they are STILL bound by the declaration and MUST go to the court and update the judge.
