yeah but you have to be specific about the type of rape, there's a difference between what Tuck allegedly did (forced sexual contact & penetration while victim was incapacitated) versus what someone like Ted Bundy did (forced sexual contact & penetration inflicting great bodily harm/death, using a weapon, and threatening violence). if convicted he would face minimum five years on the fourth degree sexual assault unless he's a first time offender, then 3-10 years on the third degree sexual assault
