Your occupation doesn't preclude you from suffering damages from felonious battery.
The devil is in the details on if Nate's actions were legal. The second set of details on if the damage he caused the plaintiff was reasonable.
It's not fleshed out yet. We'll see.
We'll see what the courts say. I tend to agree with you, but, choking someone unconscious and then dropping them back of head first on the asphalt could be construed a lot of ways by a prosecutor or civil court. We view a guillotine choke as a means of self defense, but the general public don't necessarily view it that way...it can be viewed as deadly force, as any choking would be.
Not head first. Clearly on video it was standing, and released.
Once he backed up Nate,
and nate walked away after... Nate is fine.
Unless the state has an odd interpretation of the law.
Nate is already in the clear here.

To a death (from a head hit on ground), and death far surpasses a guy trying to sue for a group brawl.
This TMZ shit is a problem in this generation because people "setup" videos to SEEM like random.
All these videos, are from a distance ... focused on a calm Nate, then a wild Nate.
Nate shows repeated rationale,
first backing up from the street to the curb, then all the way to the wall (less than 12 inches) .
HE CHOOSES choke instead of provoking punches/fists. Then, he released.
He didn't continue when the threat stopped. He walked AWAY.
This IS the evidence on the video,
and there is more to the brawl that had nothing to do with Nate.
