Long story short man charged with misdemeanor (touching a minor over her jeans) is denied a jury trial; the offense is considered petty, and the Sixth Amendment right to a jury trial applies only to “serious” crimes punishable by more than six months. He’s convicted. Man: I’m an immigrant. I will almost certainly be deported. D.C. Court of Appeals: Which is a serious consequence. He gets a jury trial. Dissent: So now noncitizens can have jury trials for petty offenses, but citizens can’t. Concurrence: D.C. officials could remedy that by restoring citizens’ right to such trials (which was stripped by legislation in 1994). Please note that this is the D.C. Court of Appeals going en banc which means the full court. This is why we need Trump. He needs to put judges on the bench that will put Americans First. Note that the media is not talking about this. I am just linking to the Court docket because for some reason its not big news that our federal court system is giving immigrants more rights than people that were born here.

sounds like this illegal may be helping the citizens get their rights restored. Don't be mad at the immigrant, be mad at the government for stripping the people of the right to begin with.

That's kind of how I interpreted it. Not that immigrants are getting more rights than citizens, but rather that citizens are getting shafted.

It's obviously both. Citizens are getting shafted and immigrants are getting more rights than citizens.

Serious question: in this context, why shouldn't an immigrant get the same rights as a citizen? Just to be punitive?

I don't really see why they shouldn't. In this instance though the immigrant was getting something not even citizens can get.

I guess I was making a broad argument that in a situation where one person has a right and another person does not, fairness should be achieved by giving rather than stripping rights. In this situation, I don't see the benefit of stripping citizens of their right to a trial.

The benefit is most likely that it saves money. Doing the whole trial jury is going to cost more money and sometimes depending on the ticket you can even have the DA just drop it cause it's not worth it.
 
Good.....Now Americans know how sort of Foreigners feel, when an American citizen commits a heinous crime and gets off free because he is American.

So yeah...American Citizens get more rights than natural born citizens.

This is a remarkably awful reason to strip someone of their right to a trial by jury. How DC even got away with it in the first place is beyond me.

Agreed. With that said I don't know for sure this is the reason but it's the only one I can think of.

The only other one I could think of is that the lawmakers realized that if people got smart and refused to take deals, the system would be bogged down for YEARS for petty shit alone and serious crimes wouldn't make it to trial for god knows how long which would violate the right to a speedy trial.

It's a shame people at large don't seem to catch on to this.

No. Immigration is done though immigration Courts which is part of the executive and Jeff Sessions is the top immigration judge. The argument here is that immigrants face a bigger threat because they face deportation so it makes the punishment "serious"

Thanks. Deportation is easily viewed as a result of a crime separate from the kid touching. Doesn't sound like it's guaranteed to happen either. Sounds to me like the same rules should apply as any other person brought up on this charge.

By definition immigrants are getting more rights due to this ruling. If I told a judge I am going to lose my job, kids and life savings would that make a crime "serious"? Of course not. Then why should the potential for deportation?
