Former UFC Champion Cain Velasquez sentencing this Monday

There's no evidence he formed a plan with the intent to kill, no text messages, prior threats, or evidence of procuring a weapon for that moment. There's no reports of him stalking, I didn't find any information on how the high speed pursuit initiated so maybe he just saw them in traffic and snapped.
“Velasquez followed the parents of 43-year-old Harry Goularte from their San Martin home to Morgan Hill to pick up Goularte, who last week was arrested and harged with molesting a close underage relative of Velasquez, but was out on bail. After the parents picked up Goularte in their Chevy Silverado, Velasquez continued following them and shot into the vehicle.”


Absolutely planned.

 
Hopefully he doesnt get caught up in any nonsense, most people will greet him with the same respect he shows them but never underestimate the stupidity of people in prison, theres always someone just looking to get their name known on the yard as they guy who hit Cain

Is there any sort of hearing or quasi trial possible to make your case heard when a fight breaks out in prison or is just down to what the guards think of the situation?
 
Soooo..according to prison protocol, Cain immediately had to find the toughest prisoner and flatline him. He will gain respect and not be messed with.
These people dont fight. They fuckin stab people.

Except its not a fact, its a blatant misrepresentation of the truth to put over a certain narrative

The step-father was never ordered by the courts to do anything, he was given an option to help a suspected P... get out of jail or let that suspected P.... stay in jail and he chose to help them get out, it was 100% his choice
 
Hopefully now we can stop hearing about it and all the posturing of either you should be volunteering to giddily shoot, strangle, drown, burn, chop up, evicerate, decapitate, dismember, etc the abuser or that proves you're a sympathizing bitch for not wanting to do so. The absolute fascination with some people wanting to do something more haneous and inhumane to the abuser than the crime they commited and do it with a smile on their face is concerning. It doesn't make you a tough guy, a good dad, or whatever else. Maybe you should live in Ancient Rome or the Middle Ages. I probably won't open a thread on this topic again.

Ok so that's some level of planning, but if someone makes a quick plan and executes it in the heat of rage there was no time for calm reflection, which is what separates premeditation from heat of passion impulsive violence.

It doesn't matter how long he planned it but it does matter if deliberation occurred during the time of planning.
That's why they'll mention how long someone had the plan to kill at trials for 1st degree murder, they'll say "he had 3 months to have a moment of deliberation."

There's no direct proof of cold-blooded premeditation in the legal sense, you can speculate or assume it, but even following them is circumstantial, they can argue he was just gonna confront them initially. Yeah he had a loaded gun, still circumstantial.
No proof of sophisticated planning, in itself doesn't rule out premeditation but he had an extreme emotional trigger which allowed them to pursue the heat of passion defense.
