I didnt know you can be discriminated based on political beliefs

A Manhattan judge ruled Wednesday that there’s nothing “outrageous” about throwing the president’s supporters out of bars — because the law doesn’t protect against political discrimination.

Philadelphia accountant Greg Piatek, 31, was bounced from a West Village watering hole in January 2017, just after Trump took the oath of office, for wearing a “Make America Great Again” cap, according to his lawsuit over the incident.

“Anyone who supports Trump — or believes in what you believe — is not welcome here! And you need to leave right now because we won’t serve you!” Piatek claims the staff of The Happiest Hour on West 10th Street told him after he and his pals complained about the rude service they were getting from a bartender.

But on Wednesday, when the bar’s lawyer, Elizabeth Conway, pointed out that only religious, and not political, beliefs are protected under state and city discrimination laws, saying, “supporting Trump is not a religion” — Piatek pivoted.

As far as I can see, Civil Service Reform Act of 1978 explicitly prohibits political affiliation discrimination....for federal employees

Laws actually vary by state where the US is concerned

For UK law, we had several controversial cases with rulings that determined "one does not have a statutory right under employment equality laws to appeal against unfair dismissal on political grounds" but can still pursue other forms of appeal especially with an uptick in years since the Equality Act 2010 for UK citizens

As someone was a bartender for about 7 years, I had to right not to serve anyone. I refused a few in those years..
I had one lady based on the law I could not serve because her husband called us to tell us she was an alcoholic and some obscure Florida Law, stated we could never serve her again. Just imagine how well that went over with her, when we told that drunk harpy we could not serve her anymore because her husband said she was a drunk.
I can still see her with one of the long brown wrapper cigarettes(think the were called Moores) dangling out of her mouth(back when you could smoke in a bar), and her yelling at my manager to quote, "You better give me a fucking drink"
I felt bad for him, she would get wasted, treat him like shit, he would get pissed off, leave, and she would find rides home with random dudes. He was like in is 70's and she was in her mid 40's. She married him for his money.

Personally I think a private business has the right to not serve anyone. It is dumb on the bars part, because both the left and rights money is green, and you are alienating other customers.
 
Can't be in employment or labor contexts. Otherwise, it's fair game to my knowledge.

If you want to wear your dunce cap in my bar, be my guest. I'll happily take your money. But the minute you start mouthing off or you start acting the part, you gotta go.

Campaign slogan affinity headwear is pretty far down the list of things that should become protected classes. We'll handle that right after we solve the horrors of discrimination against people who are fond of velcro wallets.
 
A lot of bars ban football attire because it can cause fights. Given the political climate in America at the moment I can see them using the same rationale.
